Criminal Records Search – What Are Warrants?

Warrant Records are one of the most public and readily available pieces of information in the United States. They are important for law enforcement and the reporting of crimes by those who witness them. There are two main classifications of warrants, a civil and a criminal, both of which detail the crime the person is suspected of committing. Warrant records are available in Phillips County, Montana.

Anytime that there is suspicion of criminal activity it is referred to an investigator. These investigators collect information from various resources, such as local police departments or other law enforcement agencies. From this information they can piece together enough to determine if there is probable cause to issue a warrant for the person’s arrest. Once the evidence is sufficient to justify issuance, the records are turned over to the court that is responsible.

By law, records are supposed to be open to the public but in some states this is not always the case. Each state has their own laws regarding how these records are accessed and maintained. In many states, a person who is accused of a crime does not have a right to access any criminal records unless they can prove that they were not notified of their right to access such records. In some states, records are only accessible for criminal activity. All other states afford a person the right to see records whenever they want and have access to them at will.

If a person wants to look up records, they should make sure that the person is not the person being investigated. This could prevent information that could aid in identification of the person being investigated. Also, a person cannot use the wrong person’s name when requesting information. This could lead to legal problems.

Warrant records are maintained in two ways. The first is through the sheriff’s department and the second is with the Montana state police. When a criminal act is committed the state police will serve a warrant of arrest for the person. Once they are served the person can then request that a copy of the warrant be provided to them.

To access a record one must go to the sheriff’s department. Once there they can look up a person’s criminal history. The only thing to remember is that this search must be done in person. This is so a person knows exactly what is in front of them.
